General terms and conditions
These terms apply to all orders placed through our online shop bonjourben.com.
§ 1 Scope
(1) All orders through our online shop are governed exclusively by the following terms in the version valid when the order is placed.
(2) The provider is COBEMA UG (haftungsbeschränkt), Stadthausbrücke 8, 20355 Hamburg.
(3) A consumer within the meaning of these terms is any natural person entering into a legal transaction for purposes predominantly outside their trade, business or profession (section 13 BGB).
§ 2 Formation of the contract
(1) The display of products in the online shop is not a legally binding offer, but an invitation to place an order.
(2) Durch Anklicken des Bestell-Buttons „Jetzt kaufen” geben Sie eine verbindliche Bestellung der im Warenkorb enthaltenen Waren ab.
(3) We will acknowledge receipt of your order immediately by email. This acknowledgement does not constitute acceptance of the contract. The purchase contract is only formed upon our express order confirmation or dispatch of the goods.
(4) You may correct your entries at any time before submitting a binding order.
§ 3 Prices and shipping
(1) All prices are final prices in euros, including statutory VAT, plus any applicable shipping costs.
(2) Shipping costs are shown separately during checkout.
(3) Shipping within Germany: €4.99. Free shipping on orders of €50.00 or more. Shipping to EU countries: €9.99. Shipping to other countries on request.
§ 4 Payment
(1) You can pay using:
- Credit card (Visa, Mastercard) — via Airwallex
- Klarna (instant bank transfer, invoice, instalments)
- PayPal
(2) For credit card or PayPal payments, the purchase price is due immediately.
(3) Klarna payments are subject to Klarna’s payment terms.
§ 5 Delivery
(1) Delivery is made to the address you provide.
(2) Unless otherwise stated, delivery within Germany takes approximately 3–5 working days after payment is received. Deliveries to other European countries may take longer.
(3) If we cannot fulfil the order due to force majeure, strike or unavailability, we reserve the right to withdraw from the contract. Payments already received will be refunded promptly.
§ 6 Retention of title
The goods remain our property until paid for in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Please see our withdrawal policy for details.
§ 8 Statutory warranty
(1) Statutory warranty rights apply.
(2) Defects must be reported promptly after receipt of the goods. Consumers are not subject to an obligation to inspect the goods and report defects.
§ 9 Liability
(1) In cases of slight negligence, we are liable only for breaches of essential contractual obligations and only up to the foreseeable damage typical of the contract.
(2) Liability for harm to life, body or health, for intentional misconduct or gross negligence, and under the German Product Liability Act remains unaffected.
§ 10 Online dispute resolution
The European Commission provides an online dispute resolution (ODR) platform: ec.europa.eu/consumers/odr.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Applicable law & jurisdiction
(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of protection afforded by mandatory provisions of the law of their country of habitual residence.
(2) Hamburg is the place of jurisdiction for all disputes, insofar as legally permissible.
§ 12 Severability
If any provision of these terms is or becomes invalid or unenforceable after the contract is concluded, the validity of the remaining contract is unaffected.
